Hosting & Support

Effective Date: January 9, 2026

This Hosting & Support Agreement governs hosting and support services provided by EssToo Creative, LLC (“EssToo Creative”) to its clients (“Client”) when such services are requested and billed.

This Agreement operates in conjunction with the EssToo Creative Terms of Service.

1. Scope of Hosting Services

When hosting is provided by EssToo Creative, services may include:

  • Managed hosting environment

  • Platform, theme, and plugin updates (best-effort)

  • Backups provided by the hosting platform

  • Basic uptime and security monitoring

EssToo Creative does not guarantee uptime, availability, or data integrity.

2. Support Services

Support services may include troubleshooting, configuration changes, content updates, and technical assistance related to WordPress or WooCommerce websites.

Support is provided:

  • On a time-and-materials basis, or

  • As separately scoped work, when requested

No minimum support hours or ongoing commitments are implied unless expressly agreed in writing.

3. Post-Launch Support Boundary

Immediately following website or WooCommerce launch, any updates, troubleshooting, changes, training, or support requests are not included unless separately scoped and billed. All post-launch work is billed at the applicable hourly rate in effect at the time services are rendered.

4. Exclusions

Hosting and support services do not include:

  • Legal, tax, accounting, or compliance services

  • Sales, revenue, SEO, or performance guarantees

  • Custom development unless explicitly scoped

  • Emergency or after-hours response

  • Resolution of issues caused by third-party platforms or client actions

5. Client Responsibilities

The Client is responsible for:

  • Website content, products, pricing, taxes, and policies

  • Payment gateway setup and compliance

  • Maintaining secure credentials and internal access

  • Timely communication and approvals

EssToo Creative is not responsible for issues caused by client actions or omissions.

6. Fees & Billing

Hosting and support services are billed as invoiced and are non-refundable once billed.

Hourly rates, discounted or courtesy rates, and billing structures are offered at the sole discretion of EssToo Creative and are subject to change. Work outside hosting services is billed separately.

7. Intellectual Property

All configurations, scripts, and materials remain the property of EssToo Creative until paid in full. Upon payment, the Client receives a non-exclusive license to use the work for its intended purpose.

8. Limitation of Liability

EssToo Creative’s liability under this Agreement is limited to the fees paid for hosting or support services during the applicable billing period. EssToo Creative is not liable for indirect or consequential damages, including lost data or business interruption.

9. Governing Law

This Agreement is governed by the laws of the State of Florida.

10. Acceptance

Engagement of hosting or support services, payment of invoices, or continued use of hosted services constitutes acceptance of this Agreement.
